1. General Information

1.1. NicePH (www-niceph.com.ph) (“Website” or “website” or “NicePH”) is operated by CEO Angela Nicole, a company licensed and regulated under the laws of Curaçao, under the management of Gaming Services Provider N.V., holder of Master Gaming License 365/JAZ, and registered at Zuikertuin Tower, Curaçao (“Company,” “we,” “our,” or “us”). Kashxa Limited, a company registered in Cyprus under registration number 427606, with its registered office at 2328 Yangco St, Tondo, Manila, Metro Manila, acts as the payment representative for CEO Angela Nicole.

1.2. This Agreement establishes the Terms and Conditions (“Agreement” or “Terms and Conditions”) that form a binding contractual relationship between the Company and any individual (“Player,” “you,” or “your”) who opens an account on the Website and uses the services available on the Website, including but not limited to playing games (“Services”).

1.3. The contractual relationship outlined in these Terms and Conditions is governed by the applicable laws of Curaçao, and you irrevocably accept the exclusive jurisdiction of the courts in Curaçao regarding any disputes arising from the Terms and Conditions, Services, or the Website.

1.4. All Players are required to read, accept, and agree to be bound by the following Terms and Conditions before accessing, registering, or participating in any games on this Website.

1.5. By registering with the Company and/or using the Services and/or ticking the “I accept these Terms and Conditions” box (or any similar wording), you agree to be bound by the entirety of these Terms and Conditions without any objections. Accordingly, this Agreement constitutes a legally binding document between you and the Company and governs your use of our gambling services at all times.

1.6. If a Player disagrees with any of the following Terms and Conditions or does not wish to be bound by them, we advise them to exit the Website immediately and refrain from opening an account with us.

1.7. These Terms and Conditions may be amended periodically, and it is the Player’s responsibility to review this page regularly (at least once a month). Whenever significant changes are made to the Terms and Conditions, the Company will notify the Player in advance via the email address provided during registration (“Registered Email Address”).

Players are responsible for keeping their contact information up to date, as failure to do so may result in missing important notices and account-related information from the Company.

1.8. Players are solely responsible for the safety and security of their accounts. Specifically, Players agree to keep their login details confidential and are fully accountable for any misuse of their accounts.

1.9. Players cannot hold the Company, its employees, offices, directors, licensees, distributors, wholesalers, affiliates, subsidiaries, advertisers, promoters, other agents, media partners, or retailers liable for any costs, expenses, liabilities, or damages that may arise from their:
(i) access, use, or reuse of the Website,
(ii) use of any materials on the Website,
(iii) participation in games, or
(iv) acceptance of any prizes.

1.10. These Terms and Conditions may be provided in multiple languages. Although we strive to translate the current Terms and Conditions accurately into the available languages, in the event of any discrepancy or conflict between the English version and other language versions, the English version will prevail as the authoritative reference and will be used in case of disputes.

2. Opening an Account

2.1. Personal Information
2.1.1. Cyrillic, Greek, Arabic, and other non-Latin alphabets are not permitted.
2.1.2. Personal details must always be entered using Latin characters; for verification purposes, supporting documents provided must match the information in Latin characters.
2.1.3. To play on NicePH, Players need to open an account, granting them access to various products. To create an account, Players must complete the registration process. During registration, Players will be required to provide: “Email Address,” “Country,” “Username,” and “Password.” Before Players can deposit or withdraw funds, the following additional information must be provided: “First Name,” “Last Name,” “Full Address” (including “City” and “Postal Code”), a valid “Phone Number,” “Gender,” and “Date of Birth.”

Players agree to provide accurate, complete, and up-to-date information and to inform the Company promptly of any changes to this information in the future.
2.1.4. The name registered on a Player’s account must match the Player’s legal name and identity. Furthermore, it must correspond to the name on the funding sources (e.g., bank cards, e-wallets, or bank accounts) used for deposits or withdrawals.
2.1.5. Players are only permitted to own one account. We reserve the right to close any additional accounts opened under any circumstances relating to the same individual and retain any funds within such accounts. If you discover that you have or may have access to more than one Player Account, you must notify us immediately.

2.2. Password
2.2.1. Players are prompted to create a password with at least eight (8) characters, including uppercase, lowercase, and numbers.
2.2.2. Players must not disclose their login credentials or passwords to any third party. Players are responsible for maintaining the security and confidentiality of their account details. Any unauthorized use of a Player’s password or login information is the Player’s responsibility and will be considered the Player’s activity.

2.2.3. You must notify us immediately if you suspect your login details have been compromised by a third party. Players are accountable for all activities on their accounts, and all transactions made with the correct login credentials and password will be deemed valid and executed by the originally registered Player.

YOUR RESPONSIBILITY IS TO REGULARLY REVIEW THIS AGREEMENT TO STAY UPDATED ON ANY CHANGES TO THE FOLLOWING LIST OF EXCLUDED TERRITORIES.

5. Gaming

5.1 General

5.1.1. Players agree that deposit and withdrawal transactions initiated on the Website will be processed by third-party payment processors and/or financial institutions referred to as “Payment Service Providers” (PSPs).

Therefore, to enable such processing, Players irrevocably authorize us to instruct PSPs to process deposit and withdrawal requests from the Player’s account, and agree that we may issue such instructions on their behalf when necessary. Additionally, Players agree to be bound by the terms and conditions of each applicable PSP. In the event of a conflict between this Agreement and a PSP’s terms, this Agreement will prevail.

5.1.2. By participating and playing on our Website, you acknowledge that you face the risk of losing money when using our Website, Services, and/or related software. Players are solely responsible for any losses incurred from their accounts.

5.1.3. All funds will be processed, tracked, and maintained in the currency selected by you during registration unless otherwise stated.

5.1.4. We will perform systematic verification procedures to confirm the identity of Players at our discretion.

5.1.5. Transactions are monitored to prevent money laundering and terrorism financing. Suspicious activities will be reported to relevant authorities as per legal and regulatory requirements.

5.1.6. By selecting a payment method, you agree to the corresponding terms and any displayed fees or service charges. This applies to deposit and/or withdrawal transactions made via that payment method, if applicable.

5.1.7. Players must not consider the Company as a financial institution. We do not support activities that involve storing or concealing funds on the Website, using the Website for transferring funds between payment accounts, currency exchange, etc.

5.1.8. For security and anti-money laundering reasons, we reserve the right not to process or confirm financial transactions (deposits, withdrawals, refunds) into or from accounts that are blocked, banned, or closed. This applies to accounts under investigation.

6. Refund Policy

If you use Unlimit to deposit real money into your account and do not use the deposited amount for betting, as long as there is sufficient real money in your account to cover the initial deposit, you may request a refund of the deposited amount through Unlimit. Such refund requests must be made within 30 days of the deposit.

All refunds are subject to the Company’s sole and absolute discretion and may depend on any provisions of the Terms and Conditions deemed applicable by the Company.
